Facts

Hutchinson (defendant) was convicted for possession of marijuana for sale. He filed a motion for new trial based in part on a juror’s affidavit alleging that statements and conduct on the part of the bailiff improperly influenced the jury. The trial court held that the affidavit was inadmissible and denied his motion. Hutchinson appealed.
