Facts
Michael Jackson was indicted in the state of California on charges of child molestation. Because Jackson was a famous musician, the case had a high profile and garnered substantial public and media attention. At trial, the court ordered that the grand-jury transcript, the indictment, the search warrant, and various other documents be sealed. NBC (plaintiff) alleged that this order violated the First Amendment. The trial court asserted that the sealing of the warrant was justified because of an ongoing investigation. At the time of the order, most of the information that was sealed had already been leaked and was available online.
