Facts
In an undercover operation, a police officer obtained cocaine supplied by the U.S. Drug Enforcement Administration and delivered the cocaine to a guard at a county jail. The jail guard, in exchange for money, delivered the cocaine to a juvenile inmate, Quinton Varner. Varner acted as an informant for the police and managed the bulk of the operation, including deciding which guards to target. Once the transaction was complete, the cocaine was returned to the authorities. Stephen Jamieson and other jail guards (defendants) were charged with the delivery of cocaine. The trial judge found as a matter of law that the defendants had been entrapped by the police, and dismissed the charges. The prosecution appealed. The court of appeals affirmed, and the Supreme Court of Michigan granted certiorari to review.
