Facts
In 1997, Theodore Johnson (defendant) attacked his former girlfriend, Vanessa Parker, in the presence of their three daughters. Parker and the daughters were walking home from the store, when Johnson came up behind Parker and struck her in the head. The daughters began crying and watched as Johnson dragged Parker to the apartment and demanded she unlock the door. Once inside, Johnson continued to beat Parker and threatened that he would kill her and leave the children motherless. The children entered the home and hid in a bedroom while listening to the physical and verbal abuse. Parker and the children were trapped in the home for 10 hours until Parker was able to escape and contact the police. The State of New York (plaintiff) pursued multiple charges against Johnson, including endangering the welfare of a child. Johnson was found guilty of endangering the welfare of a child, among other charges. Johnson appealed on the ground that there was legally insufficient evidence to his convictions. The appellate division reversed Johnson’s endangering-the-welfare-of-a-child conviction but sustained all other convictions. The matter was appealed.
