Facts
Petros Demetrios Latsis (defendant) was charged with two separate offenses of criminal solicitation of the crime of aggravated robbery. Latsis filed a motion to dismiss the solicitation counts on the ground that the criminal-solicitation statute was unconstitutional for reasons of vagueness and overbreadth. The district court granted Latsis’s motion, concluding that the inclusion of the modifying phrase “and under circumstances strongly corroborative of that intent” made the operative portion of the statute unconstitutionally vague. The district attorney appealed.
