Facts
Ms. Lovercamp and Ms. Wynashe (defendants) were prisoners in the California penal system. Over a few months of incarceration, Lovercamp and Wynashe were continuously threatened by a group of other inmates who attempted to force them into sexual acts and attacked them if they refused. Lovercamp and Wynashe complained to the prison authorities to no avail. After again being attacked by approximately a dozen inmates and fighting with their attackers, Lovercamp and Wynashe feared for their lives, and felt they had no choice but to flee the prison. Lovercamp and Wynashe escaped and were quickly recaptured. After being charged with escape, Lovercamp and Wynashe attempted to enter an offer of proof that they had escaped out of necessity. The court rejected the offer of proof and convicted Lovercamp and Wynashe, who appealed.
