Facts
Lubow and Gissinger (defendants) owed Max Silverman money. They proposed that Silverman obtain expensive jewelry on credit, that they then sell the jewelry and not pay back the creditors, and that the three then split the proceeds. Silverman reported this conversation to authorities and subsequently, he tape recorded a similar conversation implicating the defendants. The Criminal Court of the City of New York found the defendants guilty of solicitation to commit the felony of grand larceny. The defendants appealed.
