Facts
Former county prosecutor Michael Macklowitz (defendant) allegedly bought cocaine as a regular customer of drug dealer Jack Buccafusco. Buccafusco supplied large quantities of cocaine to two other men, who distributed to smaller-scale sellers and sold directly to users. The prosecution (plaintiff) charged Macklowitz with conspiring with the sellers to criminally possess a controlled substance. Macklowitz moved to dismiss, arguing buying cocaine only for personal use cannot make someone guilty of conspiracy with the sellers.
