Facts
The Lodge (defendant) was a restaurant and bar located adjacent to a residential area known as Paradise Estates. Approximately 33 homes were located within Paradise Estates. Several residents who lived within 600-800 feet of the Lodge complained to the sheriff’s office of loud music and noise that came from the Lodge on weekend nights. The residents who complained lived in opposite directions of the Lodge. The People (plaintiff) filed a lawsuit against the Lodge, alleging that the Lodge had created a public nuisance by playing loud music that disturbed nearby residents. The trial court ruled for the People and entered an injunction preventing the Lodge from playing any music that would be audible anywhere outside of the Lodge’s property boundaries. The Lodge appealed.
