Facts
An information was filed against McGee (defendant), charging him with rape. Additionally on the information was an older charge of second-degree burglary. McGee pled guilty and was sentenced to a term of imprisonment. Thereafter, McGee filed a motion to set aside the judgment, which was denied. McGee appealed and the Supreme Court of California granted review.
