Facts
Sixteen-year-old Michael M. (defendant) was indicted for sodomizing a 22-month-old infant. The victim’s family reacted with anger. The court received five letters from the infant’s family and friends of his parents. The court also received 16 letters on behalf of Michael from teachers, priests, and basketball coaches, expressing bewilderment and support for Michael. All letters received by the court were made available to both the prosecution (plaintiff) and defense counsel. Michael moved for recusal of the judge on the grounds that the “deluge” of letters the court had received from the victim’s family and friends had prejudiced the court against Michael.
