Facts
Moore (defendant) sold Vicodin and Xanax pills to an acquaintance, Jason Vandine. Vandine was acting as a confidential informant for the police. The State of Michigan (plaintiff) charged Moore with two counts of delivery of a controlled substance. At a bench trial, Moore testified that he felt he was under pressure to sell the drugs to Vandine. Moore said Vandine telephoned him two times per week for about one month asking to purchase the pills. Moore claimed he was entrapped by Vandine and the police to commit the offense. The trial court rejected Moore’s defense. The trial court convicted Moore. Moore appealed.
