Eric Nelson (defendant) was in the process of a contentious divorce. In a conversation between Nelson and his friend, Laura Tatarzyn, Tatarzyn referred to hiring a hit man to kill her boyfriend. Nelson believed that Tatarzyn was serious, and he asked Tatarzyn to ask for a two-for-one deal. Tatarzyn told Nelson’s wife about his inquiry regarding a hit man. In turn, Nelson’s wife told the police. An undercover officer, Juan Anguiano, who was pretending to be a hit man contacted Nelson. Nelson and Anguiano came to an understanding and arranged to meet in two days. However, Nelson’s girlfriend found out about Nelson’s plan to have his wife killed, so Nelson did not go to the meeting with Anguiano. Subsequently, the police arrested Nelson for solicitation of murder, and he was convicted. Nelson appealed, arguing that there was not legally sufficient evidence that he committed solicitation.
