Facts
William Newton (defendant) boarded a plane in the Bahamas that was bound for Luxembourg. Newton carried a loaded handgun on board. When the pilot learned that Newton may be carrying a gun, he diverted the plane and landed in New York City. Upon the plane’s landing, local authorities boarded the plane, seized Newton’s gun, and arrested Newton. Newton was charged with violating a New York statute prohibiting individuals from carrying a gun without a license. Newton filed a petition for a writ of habeas corpus challenging his detention, on the ground that his violation of the statute was involuntary.
