Facts
Teacher Phillip Premo (defendant) was charged with three counts of fourth-degree criminal sexual conduct for pinching students’ buttocks. Premo moved to quash the charges on the ground that his conduct did not amount to using force or coercion to accomplish sexual contact under the relevant criminal statute. The trial court denied Premo’s motion. Premo appealed.
