Facts
On November 8, 1959, Ms. Rodriguez (defendant) left her four children, the oldest of whom was six years of age, at home alone. Rodriguez’s home caught on fire, and one of the children died from injuries suffered as a result of the fire. There was no evidence regarding the cause of the fire. Rodriguez was convicted of involuntary manslaughter. She sought a new trial, but the court denied her request. Rodriguez appealed the judgment and the denial of her request for a new trial.
