Facts
Fifteen-year-old Roe (defendant) mixed live and blank rounds into a shotgun and decided to play Russian roulette with Seifert. Roe shot and killed Seifert with a live round. Roe was charged and convicted of depraved indifference murder. The Appellate Division affirmed his conviction, holding that the evidence was sufficient to support the conviction. Roe appealed to the court of appeals.
