Facts
Ryczek (defendant) was driving his car when he hit a boy who was pushing his baby sister in a cart, resulting in the baby’s death. The court found Ryczek would have seen the children coming had he given “the most casual glance ahead of him.” The jury found Ryczek grossly negligent and convicted him of involuntary manslaughter. Ryczek appealed.
