Facts
Cassandra Y. Cassandra was pregnant with Lou Tong Saephanh’s (defendant) child. Cassandra informed Saephanh of this while Saephanh was in prison. Five months later, Saephanh wrote a letter to a friend and fellow gang member asking him to attack Cassandra and cause a miscarriage because Saephanh did not want to pay child support. A correctional officer reviewed Saephanh’s letter and reported it to a supervisor. The State of California (plaintiff) charged and convicted Saephanh with solicitation of murder. Saephanh appealed.
