Facts
Sobiek (defendant) was indicted on four counts of grand theft for embezzling funds from his investment partnership, the Empire Investment Club (Club). The superior court granted Sobiek’s motion to quash the indictments on the grounds that a partner cannot be found guilty of embezzling property from his own partnership. The People appealed.
