Facts
Antwan Space (defendant) was witnessed shooting Mitchell Barrow and Virgil Thomas, killing one and injuring the other. Among other charges, Space was charged with and convicted of felony murder, with the underlying felony being aggravated battery with a firearm. Space appealed the conviction on several grounds, one of which was the afterthought defense. The appellate court reversed the felony-murder conviction on causation and merger grounds but addressed the afterthought defense in its analysis.
