Facts
Under California Penal Code § 647(d) it is a misdemeanor for any person to loiter in or around a public toilet for the purpose of engaging or soliciting a lewd or other unlawful act. Ralph Caswell and 15 other individuals (defendants) were charged under the statute, and moved to have the charges dismissed on the ground that § 647(d) was unconstitutionally vague.
