Facts
Ramon Valdez (defendant) was charged with grand larceny. At trial, the prosecution (plaintiff) called one witness who identified Valdez as the perpetrator. Before getting into the substance of the witness’s testimony, the prosecutor elicited testimony demonstrating that the witness was a well-educated veteran who had been awarded 47 commendations as a police officer and had been named cop of the year twice. This testimony was presented without the defense first attempting to impeach the witness’s credibility. Valdez was convicted, and he appealed.
