Facts
Todd Vecellio (defendant) interacted with “Karina,” a person he found on an adult website, via emails, instant messages, and phone calls. Unbeknownst to Vecellio, Karina was an undercover police officer working as part of a task force investigating sexual crimes against children. Karina told Vecellio that she was an adult woman who was engaging in an incestuous sexual relationship with her 13-year-old daughter. Karina told Vecellio that she wanted him to engage in sexual activities with her and her daughter at the same time. Vecellio repeatedly discussed these potential encounters with Karina and eventually planned to meet Karina in a public place and then go to Karina’s home to have sex with her and her daughter. When Vecellio arrived at the planned location, with the beer and condoms that Karina had told him to bring, he was arrested. Vecellio was convicted of conspiracy, solicitation, and attempt to commit sexual assault on a child and to enticement of a child. Vecellio appealed.
