Facts
Arlissa Wallace owned a house when she married Anthony Wallace (defendant). The couple refinanced the house shortly after getting married and made mortgage payments with community funds. The couple got into a fight, and Arlissa told Anthony to leave the house. Anthony did not leave, but tore up the house, breaking most of the belongings therein. Anthony caused an estimated $9,000 in damages to the house and $6,000 in damages to furniture and other personal property therein. Anthony was charged with vandalism, and the trial court convicted him. Anthony appealed, arguing that he could not be found to have vandalized his community property or his wife’s property inside the marital home.
