People v. Ware
California Supreme Court
14 Cal. 5th 151, 520 P.3d 601, 301 Cal. Rptr. 3d 511 (2022)
- Written by Eric Miller, JD
Facts
Nicholas Hoskins (defendant) was a member of the 5/9 Brim street gang, an offshoot of the larger Bloods gang. Hoskins was one of multiple 5/9 Brim members (defendants) charged with conspiracy to commit murder in connection with an alleged two-year conspiracy to kill members of the rival Crips gang. The prosecution presented evidence that Hoskins (1) posted extensively about his membership in the 5/9 Brim gang on social media, (2) had access to firearms, (3) was friends with a gang member who had been convicted of a specific 2013 killing, and (4) celebrated violence against rival gang members in his social-media posts. Hoskins and others were convicted and sentenced. Hoskins appealed, contesting the sufficiency of the evidence against him.
