Facts
Joel Warren (defendant) approached a woman on a trail overlooking a city reservoir. Warren began a conversation with the woman and walked back with her to her bicycle. Warren was about six feet three inches tall, weighing 185 pounds, and the woman was five feet two inches tall, weighing 100 pounds. When she got on her bicycle, Warren placed his hand on her shoulder. The woman said no, she had to go. Warren then said this will only take a minute; my girlfriend doesn’t meet my needs. Warren also told her that he didn’t want to hurt her. Warren then picked her up and carried her into a wooded area nearby. Warren told her to take her pants off, which the woman did. Warren pulled up her tank top and kissed her breasts and vaginal area. He then sat up and unzipped his pants. The woman performed fellatio on him, and then got dressed. Warren carried her back to her bicycle. The woman left and went to the police. Warren was arrested and charged with deviate sexual assault. After a bench trial, Warren was convicted. Warren appealed.
