People v. Weber
California Court of Appeal
162 Cal. App. 3d 1, 208 Cal. Rptr. 719 (1984)
- Written by Arlyn Katen, JD
Facts
Several protestors (defendants) were convicted of trespass and obstruction after they were involved in demonstrations against nuclear weapons at General Dynamics and the United States Navy Submarine Base at Ballast Point. The protestors appealed, and the California Court of Appeal consolidated their appeals. All of the protestors raise the same appellate issue: the trial court erred by refusing to allow them to raise necessity defenses.
