Facts
A New Orleans ordinance prohibited holding a funeral in a Catholic church at which the corpse was present. The First Municipality of New Orleans (New Orleans) (plaintiff) issued a criminal warrant against Father Permoli (defendant), a Catholic priest, for having celebrated a funeral in a church at which the decedent’s body was present. The New Orleans City Court entered a judgment against Permoli and fined him $50. Permoli filed a writ of error in the United States Supreme Court.
