Facts
Dorothy Perry (plaintiff) was employed as a claims processor for Blue Cross and Blue Shield (Blue Cross) (defendant) from 1983 to 1993. Blue Cross had a 3 percent maximum acceptable rate of error for claims processors. Perry’s performance was satisfactory until 1991. In 1991, Perry’s error rate was 3.7%, and in 1992 it was 4.7%. Perry received several warnings and two inadequate performance reviews before being terminated in February 1993 for excessive errors. Perry applied for unemployment benefits. The board of review denied Perry benefits on the grounds that her recurring negligence constituted misconduct. Perry appealed.
