Facts
Kenneth Perry died of a heart attack in the Saint Francis Hospital & Medical Center (defendant). A Saint Francis nurse discussed tissue donation with Kenneth’s widow, Mary Ann Perry (plaintiff). According to Perry, she agreed that Saint Francis could take Kenneth’s corneas, but not his whole eyes, and she agreed that Saint Francis could take Kenneth’s bone marrow, but not his whole bones. Saint Francis removed Kenneth’s eyes and several of his bones. Perry sued Saint Francis for breach of contract and intentional infliction of emotional distress. Saint Francis filed a motion for summary judgment.
