Facts
The National Oceanic and Atmospheric Association passed regulations that created a marine sanctuary in Monterey Bay. As part of the new regulations, the use of motorized personal watercraft was limited to certain parts of the sanctuary. However, the regulations did not restrict the use of other types of vessels. The Personal Watercraft Industry Association (association) (plaintiff) sued, arguing that it was arbitrary and capricious for the regulations to treat motorized personal watercraft differently than other vessels. The court ruled in favor of the association, and the Department of Commerce appealed.
