Facts
Jonathon Peskoff (plaintiff) and Michael Faber (defendant) were partners in NextPoint GP, LLC. Peskoff left the partnership and sued Faber for fraud. During discovery, Faber produced what he claimed to be all relevant electronically stored information (ESI) maintained on NextPoint or third-party servers. Peskoff moved to compel discovery of two years’ worth of email that Peskoff said was missing.
