Facts
James Peters conveyed certain property to the East Penn Township School District (defendant) by deed. The deed conveyed the land to the school for as long as the land was used for public school purposes. The school district ceased using the land for public school purposes and sought to sell the land. James’s heir, Earl Peters (plaintiff), filed an action for ejectment. The trial court ruled in favor of the school district, finding that the “as long as” language in the deed was not a limitation on the grant, but rather merely expressed the purpose for the conveyance. Earl appealed.
