Facts
William Peterson (plaintiff) and Brenda Carol Jason (defendant) divorced in 1985. The court awarded Jason custody of the couple’s child, ordered Peterson to pay child support, and gave Peterson visitation rights. In 1987, Peterson went back to court and moved for a reduction in his child-support obligation on the grounds that, due to his illness and job loss, he could no longer afford the payments. The court believed Peterson and cut his payments in half. However, the court also believed Jason’s testimony that Peterson rarely made his child-support payments. The court found Peterson to be in willful contempt of its 1985 child-support order and terminated Peterson’s visitation rights unless and until Peterson showed proof of his compliance with the new support-payment schedule. Peterson appealed the termination order to the Florida District Court of Appeal.
