Facts
Ann Petriello (plaintiff) filed a medical malpractice suit against Roy Kalman, M.D. (defendant), alleging that Kalman negligently performed a procedure, which resulted in Petriello having to undergo corrective bowel resection surgery that left her with an increased risk of future bowel adhesions and obstructions. The trial court instructed the jury that Petriello could be awarded compensation for an increased risk of future injury. The jury held for Petriello. Kalman appealed.
