Pfizer, Inc. (plaintiff) registered the trademark Lipitor for medication used for treatment of cardiovascular disorders and for cholesterol reduction. The generic name for Lipitor was atorvastatin calcium. Pfizer disputed the domain name lipitorinfo.com, which was registered by Van Robichaux (defendant), alleging abusive domain-name registration. Robichaux was an attorney whose law practice included providing information to prospective clients regarding injuries that might result from various medications. Robichaux maintained a law-practice website that included descriptions of these medications, problems associated with the medications, and a prompt to seek legal consultation with Robichaux. Robichaux had not yet used lipitorinfo.com but indicated he planned to use it to provide information regarding consumers’ legal rights and treatment options if the medication Lipitor was discovered to cause injuries.
