Facts
The Pharmaceutical Manufacturers Association (plaintiff) sued the Food and Drug Administration (FDA) seeking a preliminary injunction to stop the FDA from releasing information pursuant to Freedom of Information Act (FOIA) requests. Specifically, the association sought to require the FDA to provide notice to affected drug companies before any information at all was released in response to a FOIA request.
