Facts
In 1952, the government of Bavaria, Germany, enacted the Bavarian Apothecary Act. Section 3(1) of the act prohibited the licensing of pharmacies if the new pharmacies’ commercial success would harm existing pharmacies. The Germany Federal Constitutional Court then considered a constitutional challenge to the act.
