Philadelphia Storage Battery Company (Philadelphia Storage) (plaintiff) manufactured several products, including radios and batteries, under the brand name Philco. Philadelphia Storage products were sold nationally, and the brand name was well known and respected. Morris Mindlin (defendant) began selling razor blades under the brand name Philco. Philadelphia Storage filed suit against Mindlin seeking to enjoin it from using the name Philco.
