Facts
Sidell Pirus (plaintiff) brought a class action lawsuit against the Department of Health and Human Services (Department) (defendant), arguing that the Department improperly denied social security benefits to her and other similarly situated individuals. The district court granted Pirus’ request for summary judgment, and awarded Pirus attorney’s fees under the Equal Access to Justice Act (EAJA). The court found that “special factors” warranted awarding fees in excess of the EAJA’s cap of $75 per hour. The Department challenged the fee enhancement.
