Facts
The Pittsburgh Athletic Company (Pittsburg) (plaintiff), which owned the Pittsburgh Pirates, contracted to give General Mills the exclusive right to broadcast play-by-play descriptions of games occurring at Forbes Field. Forbes Field was a stadium simply enclosed by fences that prevented unauthorized entry, but still allowed those outside the ballpark to view the game from certain vantage points. General Mills then contracted exclusively with the National Broadcast Company (NBC) to broadcast the games over two Pittsburgh radio stations, KDKA and WWSW. At the same time, a rival station, KQV Broadcasting Company (KQV) (defendant), was also broadcasting the Pirates games through information learned from observers placed outside Forbes Field. Pittsburgh sought an injunction against KQV to prevent its broadcasting of the games.
