Facts

GR carried on a relentless campaign of physical and emotional abuse against PK (plaintiff), GR’s former girlfriend and fellow student at Caesar Rodney High School (defendant). PK’s mother, Judy Hassinger (plaintiff), complained to school officials (defendants) that the abuse was hurting PK’s grades. Thereafter, Hassinger and PK notified school officials each time GR threatened, slapped, or pushed PK, but they did not report the verbal abuse GR’s friends hurled at PK when they passed her in school hallways. The school officials took steps to help PK avoid contact with GR. After one particularly violent incident, the officials had GR arrested, briefly suspended, and kicked off the school’s baseball team. However, the officials’ response to PK’s and Hassinger’s complaints was sometimes grudging or callous, and the steps the officials took failed to completely protect PK from GR’s constant harassment. Eventually, PK and Hassinger sued the school and school officials in federal court for violating PK’s rights under Title IX. The school and its officials moved for summary judgment.
