Facts
In an ex parte action, Robert Plant and Jimmy Page (plaintiffs), formerly of the band Led Zeppelin, and the companies licensed to sell Page and Plant’s official merchandise sought a nationwide injunction and order of seizure against unknown vendors of unauthorized merchandise. Plant and Page, who were on a tour of the United States, alleged that the bootleggers followed them from one concert location to another. The United States District Court for the Southern District of Florida dismissed the case. The United States District Court for the Middle District of Florida granted a temporary restraining order against the unauthorized sellers in Florida, South Carolina, and North Carolina. Plant, Page, and the companies then moved the United States District Court for the Southern District of Florida for an order to show cause.
