Facts
Plateq Corp. of North Haven (Plateq) (plaintiff) contracted to sell specially manufactured steel tanks to Machlett Laboratories, Inc. (Machlett) (defendant). On the date Plateq was to deliver the tanks to Machlett, Machlett’s engineer, Albert Yannello, inspected the tanks and noted a couple of problems with them. Plateq stated that it would fix the problems and would have the tanks ready for delivery the next day. Yannello gave no indication that this was a problem, and in fact acquiesced and led Plateq to believe that a Machlett truck would come the next day to pick up the tanks. However, the next day, Machlett sent a note cancelling the contract. The note did not particularize the reason for cancellation. Plateq brought suit to recover the contract price for the tanks because since the tanks were specially manufactured for Machlett, they could not be resold. The trial court found in favor of Plateq and Machlett appealed.
