Facts
Kenneth Pledger (plaintiff) was part of a crew that was asked to do extra work for Phil Guilbeau Offshore, Inc. (defendant). To do the work, one of Offshore’s vessels used a lift basket to transfer the crew to the Offshore vessel. When the crew members stepped onto the Offshore vessel, they noticed that the deck was slippery and covered with algae. The crew members spoke among themselves and decided they could still do their work safely with a slippery deck. While working, Pledger slipped and fell under a cargo load and was injured. Pledger was covered under the Longshoremen’s and Harbor Workers’ Compensation Act, so he sued Offshore for negligence under the act. Offshore moved for summary judgment.
