Facts
Thomas Clayton was found suffering from multiple gunshot wounds. A firefighter asked Clayton who shot him. Clayton responded, “Q.” Clayton died less than an hour after the shooting occurred. Quincy Plessy (defendant) was known by the nickname Q. Plessy was charged with murdering Clayton. At the trial, Plessy filed a motion to exclude Clayton’s statement. The trial-court judge denied Plessy’s motion and admitted Clayton’s statement. Subsequently, the jury convicted Plessy. Plessy appealed.
