Facts
European Union (EU) Regulation 1099/2009 provided that animals had to be stunned before being slaughtered. The regulation included an exception to the prior-stunning requirement for the slaughter of animals pursuant to specific religious rites (i.e., kosher slaughtering) if the slaughter occurred in a slaughterhouse. The Polish Animal Protection Act withdrew the exception for ritual slaughter. In proceedings before Poland’s Constitutional Tribunal, challengers claimed that the Polish law unconstitutionally infringed on the freedom of religion.
