Facts
Under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), pesticides must be registered with the Environmental Protection Agency (EPA) (defendant). The EPA approved the registration of a pesticide called sulfoxaflor. Although the EPA determined that sulfoxaflor would not cause unreasonable adverse effects on honey-bee colonies, the EPA lacked sufficient data concerning the effects of sulfoxaflor on the development of baby bees and the long-term health of colonies. The Pollinator Stewardship Council (plaintiff) filed suit, contending that the EPA was not permitted to approve the registration of sulfoxaflor under FIFRA. The court of appeals had original jurisdiction to hear the case.
