Facts
The COMDEX/Fall trade show for the computer industry was organized by Nevada/TIG, Inc.; Interface Group-Massachusetts, Inc.; and Interface Group-Nevada, Inc. (collectively, Interface) (defendants). Interface employees walked the aisles and monitored exhibitor booths to ensure compliance with the COMDEX rules and regulations, including a rule against playing music at levels that might be considered intrusive by other exhibitors. Investigators for the American Society of Composers, Authors and Publishers (ASCAP) attended the show and overheard several copyrighted songs being played without permission. Polygram International Publishing and other ASCAP members (the ASCAP members) (plaintiffs) brought a copyright-infringement action in federal district court. Nevada/TIG was dismissed from the action by stipulation.
